These Terms of Service govern your use of eKhaya Listing (ekhayalisting.co.za). By creating an account, listing a property, or otherwise using the platform, you agree to these terms.
1. What eKhaya Listing is
We provide an online marketplace that connects people who want to buy, rent, or list property with each other and with verified agents. We are a platform — we are not a party to any rental, sale, or other agreement you reach with another user.
2. Your account
- You must provide accurate information and keep your login details secure.
- You are responsible for activity that happens under your account.
- You must be legally entitled to advertise any property you list.
3. Listings
- Listings must be genuine, accurate, and for real property you are entitled to advertise.
- No misleading prices, fake photos, duplicate, or spam listings.
- We may review, decline, unpublish, or remove any listing that breaches these terms.
- Paid listing fees are for the listing service; they are not a guarantee of a sale or rental.
4. Fees and payments
Listing and subscription fees are shown before you pay. Payments are processed by our payment provider. Unless required by law or stated otherwise, fees already paid for a published listing are non-refundable.
5. Agents
Agents apply and are reviewed before receiving a verified status. A verified badge reflects our internal review of the information provided; it is not a substitute for your own due diligence. Always confirm an agent's Fidelity Fund Certificate with the Property Practitioners Regulatory Authority (PPRA) before transacting.
6. Acceptable use
- Do not use the platform for anything unlawful, fraudulent, or harmful.
- Do not attempt to interfere with, scrape, or overload the service.
- Do not harass other users or misuse their contact details.
7. Dealing with other users
Any agreement you enter into with another user is between you and them. We are not responsible for the conduct of users, the condition or legality of any property, or the outcome of any transaction. Take normal precautions, especially before paying a deposit.
8. Our liability
We provide the platform on an "as is" basis and do our best to keep it running and accurate, but we do not guarantee it will always be available or error-free. To the extent permitted by law, we are not liable for losses arising from your use of the platform or your dealings with other users.
9. Suspension and termination
We may suspend or close accounts that breach these terms or that we reasonably believe are being used fraudulently. You may close your account at any time.
