eKhaya Listing ("we", "us", "our") operates the property marketplace at ekhayalisting.co.za. We are committed to protecting your personal information and respecting your privacy in line with POPIA. This policy explains what we collect, why, how long we keep it, and the choices you have.
1. Who is responsible for your information
eKhaya Listing is the responsible party (data controller) for the personal information processed through this platform. Questions, requests, or complaints can be sent to our Information Officer using the contact details in section 10.
2. What we collect
- Account details — your name, phone number, and email address when you register.
- Listing details — property information, photos, price, and location you choose to publish.
- Verification documents — where required, identity documents, proof of address, a selfie, and (for agents) a Fidelity Fund Certificate. These are stored privately and are never shown on the public site.
- Agent applications — CVs and supporting documents you submit to apply as an agent.
- Enquiries and messages — the content of enquiries you send to listers.
- Technical data — basic device and usage information needed to run the site securely.
3. Why we process it
- To create and manage your account and listings.
- To connect buyers, renters, landlords, and agents.
- To verify identity and agent credentials, and to reduce fraud.
- To process payments for listings and subscriptions.
- To send you service messages (for example, enquiry alerts, password resets, and listing status updates).
- To comply with our legal obligations.
4. Payments
Payments are processed by our payment provider. We do not store your full card or banking details on our servers — those are handled directly by the payment gateway under its own security and privacy terms.
5. Who we share it with
We do not sell your personal information. We share it only where necessary: with the lister or enquirer you choose to contact, with our payment provider to take payment, and with service providers who help us operate the platform under confidentiality obligations. We may disclose information where required by law.
6. How long we keep it
We keep personal information only as long as needed for the purposes above or as required by law. Verification documents are retained for the period necessary to meet our legal and fraud-prevention obligations, then securely deleted.
7. How we protect it
We use reasonable technical and organisational measures to safeguard your information, including access controls and private storage for sensitive documents. No system is perfectly secure, but we work to protect your data and to notify you and the Information Regulator of any breach as required by POPIA.
8. Your rights
Under POPIA you have the right to:
- Ask what personal information we hold about you.
- Ask us to correct or delete your information.
- Object to processing in certain circumstances.
- Withdraw consent where processing is based on consent.
- Lodge a complaint with the Information Regulator (South Africa).
9. Cookies
We use essential cookies to keep you signed in and to keep the site secure. We do not use them to track you across other websites. You can control cookies in your browser settings, though disabling essential cookies may stop parts of the site from working.
